These Terms and Conditions govern your use of aviatorcle.com (the “Site”) and your visit to The Aviator Event Center and Pub at 20920 Brookpark Road, Cleveland, Ohio. The Site is operated by UCG KAGS TGDFAB LLC, doing business as The Aviator Event Center and Pub (“The Aviator,” “we,” “us” or “our”).

By using the Site or visiting our property, you agree to these Terms. If you do not agree, please do not use the Site.

Our Privacy Policy is incorporated into these Terms by reference.

Use of the Site

We grant you a limited, revocable, non-exclusive license to access the Site for your personal, non-commercial use. You agree not to use the Site to violate any law, to submit false or misleading information, to attempt to gain unauthorized access to our systems, to interfere with the operation of the Site, to scrape or harvest data by automated means or to reproduce or republish our content without permission.

We may modify, suspend or discontinue any part of the Site at any time without notice.

Intellectual Property

The Site and its contents, including text, photographs, graphics, logos, menus, page layouts and the names “The Aviator,” “Altitude” and “Flight Bites,” are owned by us or our licensors and are protected by copyright, trademark and other laws. You may not use them without our prior written permission.

Content You Submit

If you submit reviews, photographs, comments, tags or other content to us or about us on our platforms, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display and distribute that content in connection with our business and marketing.

You represent that you own or have the rights to any content you submit, and that it does not infringe anyone’s intellectual property, privacy or publicity rights. We may remove any submitted content at our discretion.

Menus, Pricing, Hours and Availability

Menus, menu items, pricing, hours of operation, event spaces, seasonal offerings and rooftop availability shown on the Site are provided for general information and are subject to change without notice. Items may be unavailable, prices may differ at the time of service, and seasonal spaces including the rooftop may close due to weather, private events or operational needs.

We make reasonable efforts to keep the Site current, but we do not warrant that information on it is complete, accurate or up to date at any given moment. Please call us at 216-770-5300 to confirm anything you are relying on.

Restaurant Reservations

Restaurant reservations are handled through a third-party reservation platform under that platform’s own terms and privacy policy. Reservation policies, including party size limits, gratuity added to large parties, seating type, brunch pricing and cancellation or no-show terms, are stated at the time of booking and are subject to change.

Event Inquiries Are Not Contracts

Submitting a proposal request, booking a tour, receiving a quote or exchanging correspondence with our events team does not reserve a date, hold a space or create a binding agreement.

A date is reserved only when a written event contract is signed by both parties and any required deposit is received. That signed contract, together with any addenda, governs the event and controls over anything on the Site, including all terms relating to deposits, payment schedules, food and beverage minimums, guest count guarantees, cancellation, rescheduling, damages and force majeure.

Pricing ranges, package descriptions and availability discussed before a contract is signed are estimates and are subject to change.

Gift Cards

Gift cards are sold and administered through a third-party platform and are subject to that platform’s terms in addition to these Terms.

Consistent with Ohio Revised Code section 1349.61, gift cards we sell do not carry an expiration date less than two years from the date of issuance, and we do not charge dormancy, latency, administrative or other service fees within two years of issuance that would reduce the redeemable value of a card. A gift card sold without an expiration date remains valid until it is redeemed or replaced.

Gift cards are redeemable for food and beverage at our property, may not be redeemed for cash except where required by law and are not replaced if lost or stolen without proof of purchase.

Alcohol Service

We serve alcohol under a permit issued by the Ohio Division of Liquor Control. Guests must be at least 21 years old and present valid government-issued identification to be served. We reserve the right to refuse service to any person, to require identification at any time and to decline service to anyone who appears intoxicated or whose conduct is unsafe or disruptive. Alcohol may not be brought onto or removed from the property except as permitted by law and approved by us in writing.

Food Allergies and Dietary Needs

Please tell your server or event coordinator about any food allergy or dietary restriction before ordering or before finalizing an event menu. Our kitchen handles common allergens including nuts, dairy, eggs, wheat, soy, fish and shellfish, and we cannot guarantee that any item is free of a given allergen or that cross-contact will not occur.

Consuming raw or undercooked meats, poultry, seafood, shellfish or eggs may increase your risk of foodborne illness, especially if you have certain medical conditions.

Conduct on Our Property

We reserve the right to refuse entry or service, and to ask any person to leave, for conduct that is unlawful, unsafe, disruptive or in violation of our policies. Guests are responsible for damage they or their guests cause to our property.

Photography and Filming

We and our vendors photograph and record on the property. By entering the property or attending an event here, you consent to being photographed or recorded and to our use of those images in marketing, on the Site and on our social media channels without additional compensation. Commercial photography or filming by outside parties requires our prior written approval.

Vendor Partners and Third-Party Links

We list preferred vendor partners as a convenience to guests. Those vendors are independent businesses. We do not employ them, control their work, guarantee their services or accept responsibility for their acts or omissions, and any agreement you make with a vendor is between you and that vendor.

The Site links to third-party websites and services we do not control. We are not responsible for their content, policies or practices.

Accessibility

We are committed to making our property and our Site usable by everyone. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, secure or error-free.

Limitation of Liability

To the fullest extent permitted by law, The Aviator and its owners, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising out of your use of the Site.

Nothing in these Terms limits any liability that cannot be limited under applicable law. These limitations apply to your use of the Site and do not alter the terms of any signed event contract.

Indemnification

You agree to indemnify and hold harmless The Aviator and its owners, officers, employees and agents from any claim, loss, liability or expense, including reasonable attorney’s fees, arising out of your use of the Site, your violation of these Terms or your violation of any law or third-party right.

Governing Law and Venue

These Terms are governed by the laws of the State of Ohio without regard to its conflict of law rules. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Cuyahoga County, Ohio, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page and changing the “Last updated” date. Your continued use of the Site after a change means you accept the revised Terms.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
